1. Acceptance of Terms
Barrera’s IT Corporation (“BARRERAS IT CORP”) agrees to furnish web hosting and design services, software, scripts, and other related services (“Services”) to the Customer, subject to this Customer Agreement (Terms of Service). By using the Services, you acknowledge that you have read, understood, and agree to be bound by these terms. BARRERAS IT CORP may change these terms at its sole discretion at any time without prior notice. Such changes are not grounds for early contract termination or non-payment.
2. Service Description
We provide hosting and related services that enable the publication, management, and maintenance of websites and applications on our or our providers’ servers. Services may include server space, bandwidth, software tools, technical support, and other resources necessary to keep your site accessible and functional. Our hosting providers connect to the Internet through redundant high‑speed connections on diverse backbones and guarantee a 99.9% uptime (excluding up to 30 minutes of scheduled monthly maintenance without prior notification). Hardware components of leased servers are guaranteed and will be repaired or replaced within 2 hours of identifying a failure; this guarantee excludes software reinstallation and data recovery time.
3. User Responsibilities
You may use the Services only for lawful purposes. You are solely responsible for any content you make accessible through the Services and for complying with all applicable U.S. Federal, State, and Local laws, ordinances, and regulations. You must not assist others in violating these laws or this Agreement.
Prohibited Content & Activities include (but are not limited to):
- Defamatory, abusive, obscene, infringing, threatening, excessively violent, or otherwise objectionable content.
- Pornography, nudity, sexually explicit material, or links to adult sites.
- Pirated or copyrighted software (e.g., ROMs, ROM emulators, MP3s) without proper authorization.
- Hacking, phreaking, viruses, anarchy, or any material promoting harm to networks or providers.
- Sites that spoof, promote treason, acts of war, or negative views against the United States.
- Political sites of any kind (BARRERAS IT CORP will not host them).
- Bulk email (spam) services or any activity involving unsolicited messages.
Network & Server Use: You may not attempt to circumvent authentication, access data not intended for you, overload servers (e.g., flooding, mail bombing), or interfere with any user, host, or network. Unauthorized background daemons are generally prohibited and require prior approval (additional fees may apply). CGI script sharing with non-hosted domains is not allowed. Excessive resource usage may require you to upgrade or reduce usage.
Backups: As a courtesy, we provide backup services on hosting accounts, but data integrity is not guaranteed. You are responsible for maintaining your own frequent backups. Dedicated server plans may not include backups. Out-of-schedule backup requests may incur additional charges.
BARRERAS IT CORP may monitor, edit, remove, or deny access to content deemed unacceptable at its sole discretion and may disclose content or records as required by law or court order.
4. Payment and Billing
You agree to pay all fees associated with your selected Service plan. Billing cycles and accepted payment methods are outlined in your client area. Subscriptions renew automatically unless canceled prior to the renewal date. Failure to pay may result in suspension or termination of Services.
Refund Policy:
- Monthly hosting subscriptions: Refunds may be requested within 48 hours of purchase.
- Annual hosting subscriptions (or longer): Refunds may be requested within 30 days of purchase; after 30 days, in-store credit may be issued for unused time.
- Domain names and related services: Non-refundable.
- SSL Certificates: Refund periods vary by certificate; see the product description for details.
Refund or cancellation requests must be submitted through the BARRERAS IT CORP client area, including an explanation of the reasons for cancellation. Refunds are processed within 48–72 hours. Only one refund per product is permitted.
5. Termination
BARRERAS IT CORP reserves the right, at its sole discretion, to refuse or cancel service. Violations of these terms may result in warnings, suspension, or termination without refund. If your site violates any laws or policies, your information may be turned over to the proper authorities.
6. Limitation of Liability, Indemnification & Disclaimer
Limitation of Liability: BARRERAS IT CORP is not responsible for any damages your business may suffer, including but not limited to loss of data, delays, nondeliveries, misdeliveries, or service interruptions. All Services are provided “as is,” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
Indemnification: You agree to protect, indemnify, and hold BARRERAS IT CORP harmless from all liabilities, losses, expenses, claims, and reasonable attorney’s fees arising from: (1) any injury or damage caused by products sold or distributed via the Services; (2) content furnished by you infringing on proprietary rights; (3) copyright violations; and (4) any activities that violate laws or this Agreement, causing loss or claims against BARRERAS IT CORP.
BARRERAS IT CORP expects that customers who provide internet services to others will comply with all applicable privacy laws. Failure to do so constitutes a violation of this policy.
7. Changes to Terms
BARRERAS IT CORP may amend or update these policies without notice. Continued use of the Services constitutes acceptance of any changes. It is your responsibility to review these terms periodically.
